PUBLIC AGENDA COMMENTS BY STATE REPRESENTATIVE DALE SWENSON. Representative Swenson State Representative Dale Swenson reviewed the Neighborhood Revitalization Act, K.S.A. 1996 Supp. 12-17,115, as amended. Properties in designated areas have 10 year rebate periods of 95 to 100 percent. In order to be eligible for the tax rebate, properties must be located in designated revitalization areas. Council Member Kamen Council Member Kamen said this could help protect historic and other properties. Mayor Knight Mayor Knight said a careful analysis of the financial implications would need to be done and asked that Staff look into this to see how it might be used effectively in Wichita. UNFINISHED BUSINESS SPECIAL ASSESSMENTS Hearing on Proposed Assessments. Continued from October 15, 1996. (468-82514/750737/485-109) - Construction of Storm Water Sewer No. 467 (south of 21st, east of 119th Street West), as authorized by Resolution No. R-95-523, adopted November 7, 1995, and published November 9, 1995. Petition for this improvement was signed by owners representing 100 percent of the property ownership. The Statement of Cost approved July 23, 1996, in the amount of $84,307.00 is to be apportioned 100 percent to the improvement district and none to the City at large or to the Sewer Utility Improvement Fund. Mike Lindebak City Engineer said the original 100 Percent Petition was being used and the assessments have been recalculated at $980.31. The original Resolution No. R-92-168, adopted on March 17, 1992, for Construction of Storm Water Sewer No. 423, Project No. 468-82160, will be followed. Jesse Boomer Jesse Boomer said he had discussed the matter with the Special Assessments Office and his misunderstanding had been resolved. Motion carried 6 to 0. (Cole absent) LAWSUIT SETTLEMENT SETTLEMENT OF LAWSUIT - PARK CITY V. CITY AND COUNTY, CASE #96 C 425. Agenda Report No. 96-888. In February, 1996, Park City filed a lawsuit challenging Sedgwick County and Wichita actions in the annexation of tracts of land in the Riverview area north of Wichita. In April, 1996, the District Court ruled that Wichita's annexation was improper. The city of Wichita has appealed the court ruling. The injunction remains in effect. Park City has proposed a settlement which involves Park City dismissing its lawsuit and Wichita and Park City agreeing on future annexation efforts. The settlement provides that the City of Wichita would not seek annexation of properties north of 45th Street and south of 61st Street lying between the ATS&F railroad tracks and I-135. park City would drop all challenges to the city of Wichita annexation of the 442 tracts and to Wichita's future annexation of properties outside of the described area. (Cole absent) AGREEMENTS AGREEMENT FOR DESIGN OF GREENWICH ROAD BETWEEN KELLOGG AND CENTRAL. (District II) Agenda Report No. 96-889. On July 2, 1996, the City Council approved a design project for Greenwich Road from approximately 600 feet north of Kellogg Avenue north to a point approximately 600 feet south of Central. The County agreed to participate on a 50 percent County - 50 percent City basis and prepared the attached Three-Party Agreement between the County, the City and Professional Engineering Consultants, P.A. (PEC). Greenwich Road is a two-lane asphalt mat street that was built by the County. The improvement will provide four through lanes and center left-turn lanes. The Raytheon plant is on the west side of Greenwich. Mixed commercial and residential lies to the east. Payment to PEC will be made on a cost plus percentage of cost basis not to exceed $137,955 by the City and the County. The City's share is $69,217 and is funded by General Obligation Bonds included in the project budget. (District III) Agenda Report No. 96-890. On August 20, 1996, the City Council approved intersection improvements at Pawnee and Oliver. On September 12, 1996, the Staff Screening and Selection Committee selected Kaw Valley Engineering to provide the design services. The project consists of installing left-turn lanes on Oliver, upgrading traffic signals and landscaping. Within the project area, there are three petitioned projects and water mains that need to be replaced. Payment to Kaw Valley Engineering will be made on a lump sum basis of $4,180 for design of the intersection improvements, $12,540 for design of the three petitioned projects and $10,942 for design of the water mains. The intersection improvements will be paid by General Obligation Bonds included in the 1996 Intersection Reconstruction Program (CIP No. MS-412). The petitioned projects will be paid by a combination of General Obligation Bonds and Special Assessments, and the water main replacement project will be paid by Water Utility Funds included in the 1996 CIP No. W-67 - Distribution Mains Replacement Program. (Cole absent) SUPPLEMENTAL AGREEMENT FOR DRY CREEK INTERCEPTOR SANITARY SEWER. (Districts II and III) Agenda Report No. 96-891. On November 28, 1995, the City Council approved an Agreement with Mid-Kansas Engineering Consultants, Inc. (MKEC) to design the Dry Creek Interceptor Sanitary Sewer beginning at Douglas and ending at the Northeast corner of Clapp Golf Course. MKEC will design a new and/or rehabilitated portion of the Dry Creek Interceptor Sanitary Sewer including the Bleckley and Brookside branches beginning at Douglas and ending at the existing 30-inch main near the northeast corner of Clapp Golf Course. After MKEC received a notice to proceed and began work on the project, City staff requested that MKEC per- form additional work which included: preparation of a design report detailing the maximum anticipated flow to be used to size the interceptors, correcting existing maps of sewer lines in the project area, redesigning portions of the sewer line for the Kellogg/Oliver project, and alignment revisions in the vicinity of Lincoln Street. The maximum fee allowed by the original Contract will be increased by $15,636 from $93,120 to $108,756 and will be paid from Sewer Utility funds in the project budget. UNITED STATES GEOLOGICAL SURVEY SURFACE WATER AGREEMENT FOR OCTOBER 1, 1996 THROUGH SEPTEMBER 30, 1997. (All Districts) Agenda Report No. 96-892. In 1957, as a condition of federal assistance in construction of the Wichita-Valley Center Flood Control Project, the City of Wichita entered into a cooperative Agreement with the United States Geological Survey (U.S.G.S.) to install and maintain stream recorders along the project. Rainfall recorders were added later for the City's own use. In 1965, the Water Department added stream gauging stations at Cheney Reservoir. The Department of Public Works uses recorders to monitor rainfall throughout the drainage basins affecting the project to determine flood levels on incoming streams. This collected data is transmitted to the weather bureau, which transmits the data to the River Forecast Center in Tulsa, Oklahoma. The data is statistically analyzed and published by U.S.G.S. The Water Department uses this information to monitor the flow of water in and out of Cheney Reservoir, which is a source of Wichita's water supply. For U.S.G.S.'s 1997 fiscal year, the total cost of the U.S.G.S. program is $36,350, of which $10,875 is apportioned to the Water and Sewer Department, $15,675 from U.S.G.S., and $9,800 to Public Works. Of the $9,800 being paid by Public Works, $9,000 will be a direct credit to Public Works from U.S.G.S. for office space provided by the City of Wichita's Property Management Department and, $800 will be a direct cash payment to U.S.G.S. for the Agreement. Funding is contained in departmental budgets. Listed below is an itemized cost for the 1997 fiscal year funding Agreement between U.S.G.S. and the City of Wichita. On June 14, 1994, the City Council approved a development agreement with the Neighborhood Reinvestment Corporation to establish a neighborhood housing services program in Wichita/Sedgwick County. The agreement included CDBG funds to assist in paying operating costs and to establish a revolving loan fund. Sedgwick County also supports the program. Neighborhood Reinvestment Corporation (NRC) completed its analysis of potential target areas by October, 1995 and selected KenMar (13th/Kensington, Belmont/Old Manor) and Oaklawn as the areas in which the neighborhood housing services organization would undertake activities. The organization, Community Housing Services of Wichita/Sedgwick County (CHOWS), has subsequently developed specific program elements, guidelines and budgets for the two areas. The contract which has been developed includes funds to operate the program in the KenMar area. Sedgwick County funds are used for the program in Oaklawn. The KenMar program will provide rehabilitation loans in a small demonstration area to be determined by the NRC Board of Directors, home repair loans, loans for repair in conjunction with a home purchase, and purchase of a home for rehabilitation and resale. The contract amount is $150,000. Operating funds are budgeted at $50,000 for the period October 1, 1995 through June 30, 1996, and the revolving fund budget is $100,000. ACQUISITION OF PORTION OF ENTERPRISE SCHOOL (TRACT 2) FOR THE SENECA/I-235 PROJECT. (District IV) Agenda Report No. 96-896. In October 1995, the City of Wichita and the Kansas Department of Transportation (KDOT) entered into an agreement whereby the City would acquire all required right-of- way and perform all acquisition steps necessary to allow the construction of a full interchange at Seneca and I-235. Under this agreement, KDOT agrees to reimburse the City for all costs including direct acquisition. Any real property acquired will be acquired in the the name of the City. The project requires the acquisition of easements or real property from five owners. One of the acquisitions requires the purchase of two parcels of land from and the granting of two temporary easements by the Unified School District #259. The acquisitions total 41,678 and 487 square feet. The temporary easements are 1,000 and 450 square feet in size. These are located near the northeast corner of Seneca and I-235. The real property and easements were appraised at $6,250 and the review appraiser concurred with this value. This amount was offered to the owner and accepted. As mentioned above, KDOT will provide the funding source for this acquisition. No City funds are required for this transac- tion. Due to project timing, the initial payment will be made out of the Property Management Operations fund. Upon approval by the City Council, a request for payment will be forwarded to KDOT. KDOT will then reimburse the funds needed for the transaction. The Kansas Legislature adopted legislation to obligate municipalities to provide notice to crime victims of certain Court proceedings. This notice is to conform with the Victim's Bill of Rights as contained in the Kansas Constitution and current Kansas statutes. In 1993 the City Council acted to implement a Victim's Right's Program in the Wichita Municipal Court. In 1995, the City Council amended the Victim's Rights Resolution and extended the notification procedures to victims of drunk or impaired drivers. The proposed amendment to the Victim's Rights Resolution would further expand the current notification procedures to include victims of all domestic violence crimes. The Domestic Violence Coalition made this recommendation in a recently completed report on advocacy issues involving victims of domestic violence. The legislature directed that the "governing body" of a municipality implement procedures to effectuate victims' right in Municipal Court. The attached resolution complies with the statutory directive and broadens the City's definition of "victims" to be served by the Victim's Rights Coordinator. Including victims of all domestic violence crimes in the previously implemented notification procedures is consistent with the intent of the Victim's Bill of Rights and could be easily accomplished within the current process. Expansion of the victims served by the Victim's Rights Coordinator to include all victims of domestic violence crime will result in approximately a 4% increase in the total current costs/expenditures of providing this service. Staffing considerations and computer software changes will not be necessary, but there will be additional costs from postage and the material required to give notice. RESOLUTION NO. Agenda Report No. 96-899. At the April 9, 1996, meeting, the City council approved capital funding in the amount of $70,300 to be used immediately for emergency repairs to various municipal swimming pools, and agreed that the remaining $29,700 was to be used later in the year to further rehabilitate selected swimming pools as repairs were identified. Park Department Recreation Staff is requesting that the project be increased by $29,700 for a total project cost of $100,000. In the 1996/1997 budget proposal, Park Staff recommended closing three children's size swimming pools in 1996 due to deterioration of the pools and low user rates. Savings from closure of the three pools were to assist with funding for repairs to the City's eleven remaining pools. Due to the urging of citizens to keep these pools open and the need for immediate repairs to many of the swimming pools, City Council allocated capital improvement funds for the repairs in 1996. Immediate repairs were accomplished utilizing $70,300 of the $100,000 allocated by the City Council. The additional $29,700 is being requested to make additional repairs to various pools such as repairs to decks, painting, and plumbing improvements. A 96-22 A 96-22 - ANNEXATION OF PROPERTY LOCATED NORTH OF 21ST STREET NORTH DRIVE AND 1/4 MILE WEST OF HOOVER STREET. Agenda Report No. 96-900. Steven E. Cox has requested that property under his ownership be annexed into the City of Wichita. This request is scheduled for consideration by the Wichita City Council during the October 22, 1996 City Council meeting. The tract of land is approximately 1.61 acres in size. The current use of the property is single-family dwelling. The property is located north of 21st Street North Drive and 1/4 mile west of Hoover Street. The property is bordered by the current City boundary line as indicated on the referral sheet map included with this report (Attachment No. 1). Also for your reference, an evaluation sheet is included as Attachment No. 2. The acreage is zoned "SF-20" Single-Family district today, under the new Wichita-Sedgwick County Unified Zoning Code, and normally would convert to the City's "SF-6" Single-Family district upon annexation. However, the property owner has requested that the property be rezoned to "LI" Limited Industrial district in order to accommodate the future expansion of an existing machine shop located to the east of this site. This area proposed for a machine shop will be considered by the MAPC on October 17, and the City Council is tentatively scheduled to consider this request on November 19, 1996. The property owner can either hook onto an 8 inch water main located along 21st Street Drive (a frontage road) or an 8 inch main located off of Lakeway. If either of the mains are used for such service, fees in lieu of assessment will be required. If the applicant desires to connect to sewer service, he will have to extend a main from the Cox 1st Machine Addition which is already being served with City services. Fire protection can be extended to the requested annexation area within a 3.5 minute response time from City Fire Station No. 16, located at 1632 North Tyler Road. Upon annexation, police protection will be provided to the area by the officers and equipment of the Patrol West Division of the Wichita Police Department serving the western portion of the City. This property is located within the urban growth area of the City of Wichita as delineated by the comprehensive plan for the metropolitan area, and is also inside the Policy 32 urban service area. The property is located within an area that can be served with the extension of water and sewer services. The property owner will be responsible for the cost of connecting to water and sewer when the service is requested. No streets are being annexed as a part of this request. The total appraised value for the property and anticipated improvements are $171,740 resulting in an annual city tax revenue of $1,327 based on 1995 ad valorem tax levies. The property is eligible for annexation under K.S.A. 12-520 (7) of State Law.
