Council Members Cole, Kamen, Lambke; present. Council Members *Ferris, *Gale, Rogers; absent. Chris Cherches, City Manager; Gary Rebenstorf, Director of Law; Pat Burnett, City Clerk; present. The invocation was given by Maher Elassi, Islamic. The pledge of allegiance to the flag was participated in by the Council Members, staff, and guests. Minutes -- The minutes of the regular meeting of April 7, 1998, were -- approved approved 4 to 0. (Ferris, Gale, Rogers; absent) AWARDS AND PRESENTATIONS PROCLAMATIONS Mayor Knight presented the Proclamations that were previously approved. *Council Member Gale present. PUBLIC AGENDA COMMENTS BY DAN BORST. Dan Borst Dan Borst spoke regarding the WTA bus service and suggested that instead of the bus stopping in front of a homeowner's yard at Douglas and Meridian, a booth or pick- up station be installed on the west side of Meridian at the school yard. Council Member Kamen Council Member Kamen suggested Mr. Borst talk to the WTA Board regarding requests for specific stops or routes. *Council Member Ferris present. COMMENTS BY JOHN R. ANDERSON. Mr. Anderson was not present. UNFINISHED BUSINESS YOUTH COUNCIL PRESENTATION BY YOUTH COUNCIL. Members of Wichita's Promise Youth Council gave the following report: The Mission is to act as a positive voice for youth; to advise and take action on issues facing the community and give representation in order to bring about positive changes in Sedgwick County through youth involvement. The goals and objectives are: 1) To identify issues and take action when appropriate. The Council will meet once a month and invite the input of youth of all diversities through media promotion and other means of communication. 2) To form a partnership with community leaders and promote an environment of mutual respect by meeting with the City Council and Mayor every two months, and making the Youth Council available as an advisory council to other members of the community. 3) Further the mission of the founding members by maintaining consistent membership by providing one member for every 500 students from each Wichita or surrounding area high school (with at least two students from each school regardless of enrollment). The Youth Council will try to have involvement of the youth in the City and will write articles for the newspaper, develop a Web site, have a float in the River Festival parade, and do PSAs regarding the Youth Council. Mayor Knight Mayor Knight suggested the City Manager and Director of Law draft and ordinance to address having the Youth Council as an advisory council; and that the Ordinance be returned to the City Council for a public hearing. Chris Cherches City Manager said Keith Lawing, an intern in the City Manager's Office would be the liaison with the Youth Council. The Youth Council should consider whether to remain as a youth council or whether they would prefer to have youth representation on the various existing Boards and Commissions. There was no further action taken on this Item. OFF AGENDA ITEM HOUSING FOR PAROLEES. (Rogers absent) Mayor Knight Mayor Knight said he had received a FAX from Chuck Simmons, Secretary of Corrections, with information regarding parolee numbers and a message that there had been no intentional placing of unfair numbers of parolees in Wichita. Motion -- Knight moved that the City Manager and Police Chief be directed to meet right away to assess the numbers and that an assessment and recommendations with regard to whether or not the system is fair to the City of Wichita be brought back at -- carried the earliest possible time. Motion carried 6 to 0. (Rogers absent) NEW BUSINESS PETITIONS PETITION TO PAVE EDWARDS FROM ELM TO NINTH STREET. (District VI) Mike Lindebak City Engineer reviewed the Item. Agenda Report No. 98-293. The signatures on the Petition represent one of eleven ownerships that own 57% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 6-2 to recommend approval. Edwards, north of Elm, is a sand street with single family homes along the west side and an expansion of the Riverside Health Center on the east side. The estimated project cost is $232,000. The method of assessment is the front foot basis. The estimated rate of assessment is $66.19 per front foot. The signatures on the Petition represent one of eight ownerships that own 60% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 7-1 to recommend approval. The project will serve a group of single family homes along the west side of Edwards Street and an expansion of the Riverside Health Center. The estimated project cost is $85,000. The method of assessment is the front foot basis. The estimated rate of assessment is $26.44 per front foot. PETITION FOR A WATER DISTRIBUTION SYSTEM SOUTH OF 53RD STREET NORTH TO NORTH OF 55TH STREET NORTH EAST OF SENECA. (District VI) Mike Lindebak City Engineer reviewed the Item. Agenda Report No. 98-295. The signatures on the Petition represent 71 of 121 owners that own 59% of the improvement district area. CPO Council 6 considered the Petition on March 11, 1998. The Council voted 8-0 to recommend approval. A Supplement Agreement with Municipal Engineers for the preparation of construction plans has been prepared. The firm is currently designing an adjoining water system. The improvement district is primarily comprised of single family homes that are served by private water wells. An area of contaminated groundwater is located nearby. The estimated project cost is $257,000, with the total assessed to the improvement district. The proposed method of assessment is the fractional basis. The estimated assessment to individual properties is $2,400 for lots of 22,000 or less square feet of area and $3,600 for lots over 22,000 square feet of area. Mike Lindebak City Engineer explained that after looking at the improvement district, the square foot basis was a more typical assessment. Shirley Pulma Shirley Pulma said their water is bad and they have purchased bottled water for years. Motion -- Cole moved that the Petition be approved and the Resolution be adopted; and the Supplemental Agreement be approved and the Mayor be authorized to execute. -- carried Motion carried 6 to 0. R-98-118 Resolution of findings of advisability and Resolution authorizing construction of Water Distribution System Number 448-89255 (east of Arkansas Avenue, north of 37th Street North) in the City of Wichita, Kansas, pursuant to findings of advisability made by the Governing Body of the City of Wichita, Kansas, presented. Cole moved that the Resolution be adopted. Motion carried 7 to 0. Yeas: Cole, Ferris, Gale, Kamen, Lambke, Rogers, Knight. PROPOSED ASSESSMENTS PUBLIC HEARING ON PROPOSED ASSESSMENTS FOR WATER AND SEWER PROJECTS. Agenda Report No. 98-297. The Council was notified on March 17, 1998, that the proposed assessment rolls were on file for public inspection in the Special Assessments Section of the City Clerk's office. Notice of hearing was published March 27, 1998, ten days prior to the date of hearing, and affected property owners have been notified in writing. City personnel held an informal hearing April 2, 1998,, for the 39 sewer projects. Statements of Special Assessment will be mailed April 24, 1998. The property owners have 30 days from date of statement to pay their assessment and avoid paying interest. The assessments not paid during this period will be in the July Bond Sale and put on the 1998 tax roll over a 15-year spread at the interest rate for which the bonds sell. These projects were initiated pursuant to provisions of K.S.A. 12-6a01 et seq. Ray Trail Director of Finance reviewed the Item. The proposed 1998-2007 Capital Improvement Program exceeds $897 million over the ten-year period. The capital program is diverse in meeting capital needs for new and reconstructed roadways, parks, public facilities, infrastructure for new residential development, downtown development, public transit, and City enterprises (water, sewer, storm water, airport, and golf). The property tax (10 mills) provides 25 percent of the financial resources supporting the capital program. Another significant revenue source is federal/state grants at 14 percent of the total. New residential development capital costs are paid from special assessments at 15 percent. The City's enterprise activities fund capital projects through fees constituting 43 percent of total CIP financial resources. Local Sales Tax is funding only 3 percent of the proposed CIP at this time, and is based on freeway segments approved by the City Council to date. Additional Local Sales Tax resources are available to finance new freeway construction at such time as a determination is made on future freeway construction priorities in 1998 if federal or state highway funds become available. Capital projects are financed in a variety of ways: general obligation bonds/notes, revenue bonds, grants, and cash. The most significant is general obligation (GO) bonds based on the full faith and credit of the City. GO bonds provide debt financing not for property tax funded projects, capital projects with debt paid by enterprises, and special revenues such as the Guest Tax. Debt service payments for GO debt are spread either to the Debt Service Fund or the various enterprise and internal service funds, as appropriate. David Warren Director of Water and Sewer said there has been significant expense with the development of future water supply for the City. Council Member Lambke Council Member Lambke spoke regarding Fire Station Number 6 and questioned the rationale of it being set back in the CIP. Larry Garcia Fire Chief explained that there had been no provision made previously for purchase of a site. The site purchase is now scheduled for 1999 with construction scheduled for 2001. There is a need for the fire station. OSHA has now mandated that there be no entry into a structure with fire without a back-up team on site. This means the previous practice of entering a burning building immediately upon arrival, knowing a back-up team is on the way, is no longer possible. The southeast fire station is important as the response time is already at the maximum. A Fire station is also needed for the far northwest. Because of increased annexation, the Fire Department cannot continue to provide response the City is used to - even with the first responder program if resources are not provided. Council Member Lambke Council Member Lambke said there is an increase in manufactured homes in the southeast and that he would like to ask that Fire Station No. 6 land acquisition be set up for 1998 with design build in late 1999. Mayor Knight Mayor Knight asked that the City Manager and Staff return with an analysis on moving the project up for construction in 1999; and that the Director of Finance and City Manager meet with the Fire Chief regarding the implications and the possibilities with existing stations. Council Member Ferris Council Member Ferris said he would like the Fire Chief and Staff to analyze the entire Fire Department and needs and return the analysis to the City Council. Council Member Ferris said he is not willing to compromise fire safety of the community for parking lots and bridges. Mayor Knight Mayor Knight inquired if anyone wished to be heard. Stan Wilson Stan Wilson, Joyland Amusement Park owner, said the Gypsum Flood Control is unfunded and a major flood would cost his business a lot of money. Any excess water floods the parking lot and the rest of park has 4 to 10 inches of water. Mr. Wilson stated that he has been working with Mr. Mitchell to find a workable plan for presentation. Steve Lackey Director of Public Works said the previous project to improve the section was a concrete lined channel which the review agencies objected to as being not environmentally friendly. The design needs to try to maintain the basic alignment and vegetation. Permits were received to build the revised design but Mr. Nelson felt the revised design was not sufficient to address the flow needs in the area. Mr. Mitchell has been trying to get the review agencies to change their opinions so the original design can be used but no response has been received to-date. The project, if built as designed the second time, would cost $2 million. If the debate is to continue with the review agencies, the City is in a holding pattern until an answer is received. Jay Swanson Jay Swanson, Wichita Crime Commission and Co-Chairman of the Leadership Committee of the Long Range Planning Task Force, spoke in support of an advisory referendum of Sedgwick County voters as an appropriate way to test public support for the merger of the two governments. Mr. Swanson urged the City Council to place such an advisory referendum on the ballot for City voters and said he would recommend that the Sedgwick County Commission do the same for county voters outside the City of Wichita. On November 6, 1997, the City Council approved a new governance structure for the Wichita Art Museum. Effective January 1, 1998, the City of Wichita succeeded the Wichita Art Museum Board to the rights, obligations, and control over the Wichita Art Museum. The former Board held several trusts in its name, primarily the Burneta Adair Endowment Trust and the Wichita Art Museum Board Trust (consisting of a number of individual trusts), invested at several local banks. A number of these trusts have restrictions on the use of the principal or income placed by their grantors. The City of Wichita succeeded to the fiduciary responsibility for the investment, management, and proper use of these trusts. All decisions relating to the trusts now rests with the City Council, and affirmative direction through Council action is necessary for any decisions on use of the trust funds or changes in investment and management. The Council may make the decision, however, to delegate any or all of these decisions to the new board (the Wichita Art Museum, Inc.). On January 6, 1998, the City Council approved an agreement with the Wichita Art Museum, Inc. (a _501(c)(3) tax exempt corporation) to take over the operation and management of the Art Museum. The ordinance and agreement delegated management control over the works of art to the new Board (decisions on disposition or transfer of title of art works must still be approved by Council). The new board has now also asked to have direct responsibility for the management and use of the trust funds for the continued operation of the Museum. The Supplement Agreement delegates the Wichita Art Museum, Inc., to act on behalf of the City and have general supervision and management of all the existing and future Art Museum trust funds. This board is required to invest and use the funds in accordance with any restrictions and conditions placed by the grantors and in compliance with statutory fiduciary responsibilities. It may amend restrictions placed by only the old WAM Board, however. The new board will report on the investment and use of the trust funds in its periodic reports to the City Council and through Council review of the Art Museum budget. The Wichita Art Museum, Inc., will be required to continue to separately account for the investment and use of each trust fund. Mayor Knight momentarily absent with Vice Mayor Cole in the Chair.
