UNFINISHED BUSINESS CONDEMNATION REVIEW REVIEW OF 1136 N. MARKET. Kurt Schroeder Superintendent of Central Inspection reviewed the Item. Agenda Report No. 97-1042 C. Property first cited for violations March 23, 1973. Coy Lybrand was the property owner from that time until March 30, 1998, when the property was sold to Gail Duarte. Ms. Duarte has confirmed that she is willing to sell/transfer property title to Mr. John Walke. As of April 13, 1998, the property was secure, most of the junk cars had been removed, and the premises were secured. Staff recommends 60 days to complete necessary repairs. Mr. & Mrs. Walke Mr. and Mrs. Walke said they have the loan work done and would like to start repairs this week. The plan is to complete the front porch and foundation repairs, do additional cleanup, and start the siding work in 30 to 60 days. Motion-- Cole moved that the building be removed from condemnation proceedings and that 60 days be given to complete the plan of action set forth by OCI (significant -- carried exterior problems repaired). Motion carried 7 to 0. Council Member Cole left the Bench. NEW BUSINESS CIVIC CENTER U.R. CIVIC CENTER URBAN RENEWAL PLAN - TERMINATION OF RESTRICTIONS. Gary Rebenstorf Director of Law reviewed the Item. Agenda Report No. 98-335. In 1964, the City adopted an urban renewal plan for the Civic Center (known as Project R-19). This plan has controlled development of the City-owned civic center as well as privately owned land, including that north of Douglas used by the First National Bank garage and the Garvey Center. The Plan establishes the appropriate uses and development standards. The Plan has been incorporated into contracts and deeds for the sale of land for private development in the area. In addition, restrictive covenants were filed of record applicable to Civic Center North (north of Douglas) on May 1, 1968. (No restrictive covenants were filed on Civic Center South.) The Plan has been amended on several occasions. In 1984, the City amended the Plan to allow for a transit center and parking garage in an area east of Century II. This amendment was opposed by the First National Bank. In the resulting litigation, the Court ruled that the City had to obtain the consent of the First National Bank for any amendments to the urban renewal plan, even those amendments affecting only City-owned property. The consent was required because of contractual requirements in the documents that sold portions of the land for private redevelopment. The restrictions of the urban renewal plan are effective for 30 years after the recording of restrictive covenants and are automatically continued for 10 year periods thereafter unless terminated as provided in the Plan. The Council has the opportunity to consider whether it wants to continue or terminate the restrictions. The Civic Center Urban Renewal Plan will continue automatically for another 10 years after the first 30 year period ends May 1, 1998, unless terminated. The Plan allows the restrictions to be terminated at the end of any period by the owners of a majority of the area covered by the Plan, upon approval of the City Council. Because the City of Wichita owns a majority of the land (79.53%) it has the authority to make this decision itself. The Plan's restrictions apply to both the publicly owned properties (Century II, Exposition Hall, Downtown Library, and public parking) as well as private properties (Century Plaza Building, Intrust garage, and Garvey Center). Planning Staff has reviewed the impact of termination of the restrictions: Most of the developmental guidelines established in 1964 are now covered by other codes such as the building code, sign code, landscape ordinance, and zoning code. The Plan does incorporate setback requirements for Douglas Avenue ("boulevard" appearance) that are not currently covered anywhere else, however. These requirements could be re-established in the future by zoning ordinance if needed. Removal of the restrictions will give the City more flexibility in future decisions on the use of City-owned property without having to obtain consent of private property owners elsewhere in the urban renewal area. The "no action" alternative will retain the urban renewal plan and its development restrictions for another 10 years. The Council will have the ability to consider this issue again prior to May 1, 2008. The City Council has the legal authority to terminate the urban renewal restrictions by action prior to May 1, 1998. (Cole absent) RESOLUTION NO. R-98-150 A Resolution of the Governing Body of the City of Wichita, Kansas, pertaining to the termination of restrictions of the Urban Renewal Plan for Civic Center Urban Renewal Project (No. R-19), presented. Knight moved that the Resolution be adopted. Motion carried 6 to 0. (Cole absent) Yeas: Ferris, Gale, Kamen, Lambke, Rogers, Knight. Council Member Cole present. TOUGH MAN CONTESTS PROPOSED ORDINANCE PERTAINING TO TOUGH MAN CONTESTS. Chris Cherches City Manager reviewed the Item. Agenda Report No. 98-336. The City Council requested that Staff review the regulations involving "Tough Man Contests" and whether such events should be abolished. The matter was also referred to the Board of Health and the Park Board for review/recommendation. The central issue is whether or not the City Council wishes to have the authority to permit professional boxing and wrestling matches, and non-sanctioned amateur boxing events within the City limits. These events cannot be held in the City without an Athletic Commission. If the Athletic Commission remains in existence, it can still place restrictions on the type of events that can be authorized; that is, such events as the Tough Man Contest can be abolished. Possible Options available to the City Council are: 1. Eliminate the Wichita Athletic Commission, thereby prohibiting professional boxing and other such events inside the City of Wichita. 2. Restrict the authority of the Wichita Athletic commission and prohibit certain type of events (i.e., Tough Man Contests, kick boxing, etc.) that can be licensed. 3. Turn the authority over to an independent, but designated group. Two such possible groups were the Wichita Sports Commission or some County-wide group. Neither of these groups, however, are interested in assuming this responsibility. The Board of Health and a subcommittee of the Board reviewed the issue of Tough Man contests and recommends that Tough Man Contests should be banned in the City of Wichita. During the review process by the Board of Health, the Medical Society was contacted and indicated that since the American Medical Association (AMA) is opposed to all types of fighting, including Tough Man Contests, they do not want to be referenced in the current Ordinance. The Park Board reviewed the issue and took no action. The proposed Ordinance provides that licenses shall not be issued and no event shall be permitted within the City which involves tough man contests or any similar combative fighting events involving non-professional contestants. Further, the Ordinance names the Sedgwick County health officer to serve as medical advisory to the Athletic Commission. The proposed revisions will not affect high school or collegiate athletics. Mayor Knight Mayor Knight inquired if anyone wished to be heard. Greg Gorrell Greg Gorrell, former professional fighter, said he had reservations about the process with regard to who was interviewed and the considerations with regard to the number of people hurt. Mr. Gorrell said that none of his boxing associates had been interviewed or contacted. There have been 1,000 individual fights with only one injury. The person injured had severe headaches (thought to be migraines) for up to one month before the event and that person probably should not have participated; however, that person chose to participate. Mr. Gorrell said it is unfair to get rid of a sport because of one injury. The Tough Man participants are required to wear 15 ounce gloves and headgear and kidney protection. Each round lasts one minute. Council Member Ferris Council Member Ferris said high school football and rugby are among the most dangerous sports. Evaluating the regulation of choice should be done when the evidence is overwhelming that regulation is necessary. Evaluation of the Tough Man Contest should have included Greg Gorrell and others involved in the sport. Gary Rebenstorf Director of Law explained that all interviews were conducted by the Park Department with the Health Department reviewing. The Law Department reviewed the matter from a legal standpoint. Missouri adopted a State Law in August, 1997, which bans the Contest. Ohio and New York have instituted tough restrictions. Motion -- Ferris moved that the Item be sent back to the appropriate committee for investigation of the possibility of more restrictions and that Greg Gorrell be involved; and that the City Council take action as a result of the investigations. Council Member Cole Council Member Cole said the Athletic Commission should be involved and should give advice on how to deal with these things. Mayor Knight Mayor Knight stated that the did not think the challenge was too much regulation, rather that there is not enough regulation. -- carried Motion carried 6 to 1. Knight - No. SNAP-IT PROGRAM PROPOSED ORDINANCE AMENDMENTS PERTAINING TO PARKING IN HANDICAPPED SPACES (SNAP- IT PROGRAM). Gary Rebenstorf Director of Law reviewed the Item. Agenda Report No. 98-337. Proposed amendments to the current ordinance create a new violation for failure to display a valid placard and will be utilized primarily by prosecutors for defendants who have a valid placard but forget to display it while parked in a handicapped space. The fine is set at $50. A court appearance will not be required to obtain the amendment which can be completed by a prosecutor upon verification of the information. The proposed amendments retain the $100 mandatory fine for violations of the ordinance. The provisions for the municipal court judge to remit a portion of the fine to $50 has been deleted. Plea negotiation guidelines to review handicapped parking tickets on a case-by- case basis has also been developed. The process will provide an opportunity for a handicapped defendant who fails to hang the placard to have the case reviewed by a prosecutor to determine whether there is a basis for dismissing, amending, or prosecuting a ticket. The charge may be amended to a $50 fine for a second offense. After the second offense, violations will be subject to the mandatory $100 fine. ORDINANCE An Ordinance amending Section 11.52.020 of the Code of the City of Wichita, Kansas, pertaining to unlawful parking, and repealing the original of said Section, introduced and under the rules laid over. IRB/TAX ABATEMENT TAX ABATEMENT AND INDUSTRIAL REVENUE BOND POLICIES. Council Member Kamen momentarily absent. Allen Bell Director of Financial Projects reviewed the Item. Agenda Report No. 98-338. The City of Wichita began issuing industrial revenue bonds (IRBs) in 1963 with the issuance of $4.5 million IRBs for the construction of the original Learjet plant next to Mid-Continent Airport. Since then, the City has issued nearly $4.7 billion in IRBs, representing nearly 300 separate bond issues for over 200 different companies. In 1997, the City Council approved 19 separate IRB issues. The average number of new issues per year since 1991 has been 13. The City's current policy governing the issuance of IRBs is in the form of a resolution that was adopted in 1984. Many of the IRBs issued since 1963 have included the abatement of all or part of the taxes on the property being financed with the proceeds of the IRBs. Since 1987, the City has provided tax abatements to expanding manufacturing and other businesses, without going through IRB issues, under the Wichita Business Incentive Policy. This policy, based on a 1986 amendment to the Kansas Constitution, is also in the form of a resolution, which was last updated in 1991. Following a workshop presentation on February 17, 1998, the City Council directed staff to update both the tax abatement and IRB policies and present the redrafted policies for Council consideration. IRB Policy The IRB Policy covers the eligibility of projects for IRB financing, as well as the tax abatement, project requirements, letter of intent conditions and procedures for the actual issuance of the IRBs. The only proposed change is a requirement that multi- family housing projects that involve the acquisition of existing facilities must also include rehabilitation of the property costing at least 20% of the acquisition cost. IRB tax abatement is proposed to be covered by the Business Incentive Policy, which heretofore covered only economic development exemptions (EDX) authorized by the constitutional amendment. The proposed IRB Policy therefore cross-references the Business Incentive Policy with regard to tax abatement. Under the proposed IRB Policy, prospective tenants would be required to use the bond counsel designated by the City, which may include the City's regular contract bond counsel. In addition, the proposed policy allows for exceptions to the requirement that audited financial statements be provided, but only in cases where the business is a start-up with no operating history, where the bonds are fully guaranteed by a letter of credit or bond insurance policy or where the bonds are purchased by the company's principal lender. The proposed updated IRB Policy includes all of the standard conditions that have been incorporated into letters of intent over the years, and adds several new conditions. Most notable of these is the condition that an applicant must agree to provide proof that procedures were used in the selection of contractors, consultants and vendors for the IRB project that do not exclude minority-owned or women-owned businesses. Another noteworthy new condition requires applicants in projects involving the construction of corporate headquarters to maintain their headquarters in Wichita so long as bonds remain outstanding or tax abatements are in effect. Other new conditions involve indemnification, insurance, payment of back taxes, and legal opinions. The proposed IRB Policy provides a detailed description of the procedures for obtaining a letter of intent and for the actual issuance of the bonds through first and second reading of the bond ordinance and subsequent closing of the bond issue, including documents to be submitted and time frames for submission. The detailed procedures have been prepared by the City Attorney's Office and conform to current practice. Business Incentive Policy The principal change to the Business Incentive Policy is the incorporation of IRB tax abatements into the Policy along with EDX abatements. As a general rule, the proposed Business Incentive Policy treats IRB and EDX abatements the same. In determining the amount of tax abatement, for example, the same formula is applied to both IRB and EDX projects. Distinctions are made between IRB and EDX abatements only when state law requirements necessitate different treatment, such as in the types of businesses that are eligible for EDX abatement. Unlike IRBs, EDX abatements are limited by law to three types of businesses: manufacturing, research and development relating to manufacturing and storage of goods or commodities sold or traded in interstate commerce. The proposed Business Incentive Policy has been changed to require that storage facilities must be permanent improvements to the land and not movable containers such as trucks, trailers or railroad cars. The amount of abatement for either IRB or EDX projects is determined by application of the same formula under the proposed Business Incentive Policy, based on job creation, capital investment, export activities and project location. The formula itself has not been changed in the proposed Business Incentive Policy. If a business does not export its products out of the state, it will not qualify for more that a 50% abatement under the Business Incentive Policy. In the current Business Incentive Policy, EDX projects are accorded the full amount of abatement for which they qualify for the first five years only. For the second five years of the abatement, EDX projects receive half the amount of abatement on real property and none for personal property. This is continued in the proposed Business Incentive Policy, for both EDX and IRB projects. Current policy and practice with regard to the term of IRB abatements is to grant an initial five year term, plus a second five years if a review at the end of the first five years shows that the company has generally complied with the conditions under which the abatement was originally approved, including job creation, capital investment and export activity. Under the proposed changes to the Business Incentive Policy, the same "5 plus 5" year term is applied to both IRB and EDX projects. Because of the importance of IRBs and tax abatements as economic development tools, the Council's policies should preserve the City's ability to be flexible in response to critical economic development situations. Therefore, in both the proposed IRB Policy and the proposed Business Incentive Policy, the City Council retains the discretion to make exceptions to the policies if circumstances warrant such exceptions. The current fees required under the IRB and Business Incentive Policies have not been changed in the proposed changes to the policies. R-98-151 A Resolution finding that the City of Wichita intends to issue its Industrial Development Revenue Bonds pursuant to K.S.A. 12-1740 to 12- 1749d inclusive, as amended, to promote economic development of the City and establishing policy, guidelines, and procedures for issuance of said bonds, presented. R-98-152 A Resolution for granting Ad Valorem Tax Abatements as an incentive for business development and expansion in Wichita, Kansas, presented. Knight moved that the Resolution be adopted. Chris Cherches City Manager reviewed the Item. Agenda Report No. 98-339. The current Administrative (Policy #5) reimburses employees for personal use of an automobile when traveling on City business at the rate of 25 cents per mile. This reimbursement rate for personal use of an automobile has not been updated since 1981, even though the cost of operating and maintaining a vehicle has increased. In determining the increase in the mileage rate, other governmental units were surveyed. The policy changes proposed increases the mileage reimbursement rate from 25 cents to the IRS rate, less two cents. The financial impact from the increase from 25 cents to 29.5 cents per mile is estimated at $3,000 each year. Mayor Knight Mayor Knight inquired if anyone wished to be heard and no one appeared. PROPERTY ACQUISITION DONATION OF 1847 WELLINGTON PLACE PROPERTY. Chris Cherches City Manager reviewed the Item. Agenda Report No. 98-340. The historic property at 1847 Wellington Place (original L.W. Clapp residence) has been offered to the City of Wichita by Mr. & Mrs. Ron (and Renae) Ryan. This property has been the Ryan home for some years. The Ryan's have made significant investment to restore and maintain this historic property and feels that it should be preserved and enjoyed by the community for public use and care. The home was completely restored in 1982 with all new plumbing, mechanical and electrical systems and is in excellent condition. Although the Ryan's could recover much of the investment they have in this property, they prefer to gift it to the City of Wichita. The home was originally constructed in 1896 and was the home of L.W. Clapp, former Mayor of the City of Wichita. The property contains about 55,575 sq. ft. and has a 300-foot frontage on Wellington Street. There are 18-rooms, including seven bedrooms and six baths, about 8,000 sq. ft. of living space. The property occupies about three acres of land, including a garage (with living space above), swimming pool, and other features. The property has been appraised at $725,000 for historic and public use purposes. If the City Council approves of this donation and accepts this historic property, it will be utilized initially as a special place where meetings, retreat sessions, receptions, banquets, weddings and other uses could be accommodated. In addition other community uses, including but not limited, to board/commission meetings, sister cities events, training sessions, historic tours, and other events could be scheduled. To assure the upkeep and maintenance of this facility for the future, consideration will be given to a non-for-profit group to oversee and manage this historic residence. Upon acceptance, the City will seek a caretaker to live on site in the apartment unit to manage, maintain and provide the needed security for the property in exchange for the rent and utility expense. Initially, this property will be maintained by the Park Department. In addition, the Botanica will be asked to establish a small display garden area for visitors and tours. A budget has not yet been established for this property which will be required to support the upkeep and to provide the necessary furnishings. It is hoped that donations of furniture of the historic era will be donated to furnish the home. Some of the expense will be offset with rentals and contributions that are anticipated in connection with the special events that will be programmed. The City Attorney's Office will work with the Ryan's in the title work required for the contribution of this property to the City. If the gift of this property is accepted by the City Council, the title work can be completed immediately. Mayor Knight Mayor Knight inquired if anyone wished to be heard and no one appeared. Motion carried 7 to 0. CITY COUNCIL AGENDA Motion -- carried Knight moved that Item 9 be taken up out of order. Motion carried 7 to 0. (Item No. 9) HILLTOP FACILITY DISCUSSION OF HILLTOP FACILITY. (Requested by Council Member Lambke) Chris Cherches City Manager reviewed the Item. Agenda Report No. 98-342. Bids were taken on March 13, 1998 on the Hilltop building renovation. Only one bidder responded, with a base bid of $366,000, with desired alternates the total amounted to $379,070. The Engineer/Architect estimate was $245,000. The Council must decide if this building is to be renovated, razed and reconstructed, or other improvements made in the adjacent park land in lieu of a building. The initial budget for this project was $275,000. Deducting the architectural ($19,350); asbestos removal ($7,160), and miscellaneous costs ($1,003.38), balance remaining is $247,486.62. The Council has a number of options for consideration, these include: 1. Accept the bid, with alternates. This will require an additional allocation of $131,409 from CDBG funding. 2. Negotiate with the low bidder the minimum amount of work within the budget allocation. 3. Reject the bids and redid, but delete some of the proposed work. A slight additional cost will be incurred from the architect to alter the plans/specs. 4. Demolish the building and design smaller building without the gym or other features. This option may equal or exceed current budget. 5. Demolish building and put money into park development, such as picnic shelter, basketball courts, expanded playground, etc. 6. Other One of the concerns with a renovated or new building is the operational costs for continued maintenance and operating expenses. This facility is not needed for governmental services, but the neighborhood has been supportive of returning this building into a neighborhood center. Past efforts of finding social service or other governmental agencies to occupy and oversee this building have been unsuccessful. If the building is retained, improved or a new building is constructed, considerations must be given to the ongoing operational and maintenance costs. No funds are included in the annual operating budget for this facility or the necessary operational costs. At one time, it was suggested that the Health Department relocate one of its health stations to this site. The Health Department has agreed to move from its current location and place a health station at Hilltop. However, this would require building modifications and added operational expense of the Hilltop facility. An additional cost of $94,700 would be required to alter the building for Health Department use, exclusive of higher building operational costs. In addition, higher operational costs would be incurred above what the Department is currently paying at its current location. The Department does not feel that the added costs would warrant a relocation of this health station. There is strong neighborhood support for a community building. If the City wishes to encourage neighborhood investment, neighborhood pride and revitalization of the Hilltop neighborhood, providing this facility may be a good investment for the City. However, the City Council needs to address added operational and maintenance costs to an already limited budget for maintaining existing City- owned facilities. Additional funds could be programmed from CDBG income to increase the Hilltop project if the Council desires. However, such funds are not available in 1998 for maintenance and operational expenses. Council Member Lambke Council Member Lambke said nothing can be done with the building and recommended that Option 4, and reservation of the site for future construction, posthaste, be approved. Council Member Lambke also said he will eventually ask for additional funds. It is estimated that a new building will cost $400,000. Mayor Knight Mayor Knight said the budget has been set for the building and that the primary concern is maintenance. Interest and commitment are different matters. The Tenants and maintenance should be finalized before a new building is built. Council Member Lambke Council Member Lambke agreed and said he would not ask for moneys to be spent until there is a firm commitment. This is only indicating that steps should be taken to demolish the building. Council Member Rogers Council Member Rogers stated that he hoped this would include that the Manager's Staff look at design and budget for a new building that would provide services necessary to the City. A Representative from the Hilltop area said the group is still discussing the project and that another meeting will be held this evening. Pat O'Donnel Pat O'Donnel said there are plans for park activities for youth. The Partnership has discussed uses for the City at-large. The Partnership is open to facilities for a healthier neighborhood and for the community at large. Council Member Lambke Council Member Lambke said he hoped there would be funds available to construct a facility in 1999. Motion -- carried Lambke moved that the building be demolished. Motion carried 7 to 0. FOUR-MILE CREEK SEWER DISCUSSION OF FOUR-MILE CREEK SEWER DISTRICT. (Requested by Council Member Kamen) Council Member Kamen Council Member Kamen reviewed the Item. Agenda Report No. 98-341. In 1977, the Wichita-Sedgwick County Health Department declared "a need for planning and the orderly development of sewage treatment facilities in the Four Mile Creek basin." The basin covers an area of 9,300 acres - east of Wichita to the Sedgwick/Butler County line. In 1980, the projected population that the Four Mile Creek (FMC) sewer district facilities would serve by the year 2000 was 35,436. The FMC treatment plant was completed by the County in 1988 at a reported cost of $8.7 million. The EPA supplied grants totaling $1.6 million. The County financed a reported $7.1 million for Phase I improvements which also included the Crestview and Spring Creek interceptor sewers. Subsequently, the County added the Timberlakes and Minneha interceptor sewers (Phase II) with a reported cost of $4-5 million. In 1989, the County offered to sell the facilities (Phase I) to the City for $7.1 million. The City countered with a purchase offer of $6.1 million based on known costs and conditions. This offer was rejected by the County. Recent annexations by the City and within the service boundaries of the 4-Mile Creek District (i.e. Gilders Garden and Gott Addition) have prompted discussions of equity regarding sewer charges with other sewer utility charges to Wichita customers. Staff was recently asked to present current data on 4 Mile Creek Sewer District (FMC) operations and financing and to analyze the feasibility and impact of acquisition options of FMC physical plant facilities (treatment plant and interceptor sewers) by the City's Sewer Utility. The following options were considered: 1. Continue as County operation. 2. Outright purchase of FMC facilities. 3. "Buy down" FMC debt service on facilities based on percentage of customers acquired by each City annexation of FMC service area. 4. "Buy down" FMC's operating and maintenance costs based on the percentage of customers acquired by each City annexation of FMC service area. 5. A combination of options (above). Staff assembled data from published sources including the County's budget document and CAFR that pertain to the analysis. Among the relevant data are the following: Basic Information * 1998 Sedgwick Co. Sewer Operations and Maintenance budget (includes costs pertaining to 3 other district operations in addition to FMC): $1,019,000. * Approximate number of customers currently served by FMC: 3,600. * Current average daily flow is 0.8 million gallons per day (MGD). * Design plant capacity is 1.5 MGD. * System is projected to reach its design capacity limit of 1.5 MGD in nine (9) years. * A recent independent engineering analysis of FMC recommends the expenditure of $2,700,000 for capital improvements designed to deal with anticipated system growth and to meet more stringent treatment standards. Rate and Comparative Billing Information * Monthly user fee charges to FMC customers: $13.50. * Annual County general tax levy to Sewer District customers (supplements user fees): $175,000. * Estimate of effective rate for sewer service to FMC customers (includes user fee and pro rated share of mil levy): $204.12/yr. * Additional costs paid by FMC customers through assessments: Phase I Assessment = $200/yr. or $16.67/month. Phase II Assessment = $50/yr. or $4.17/mo. Note: This monthly assessment is paid by customers who were existing in these Phases when the costs were spread. For those customers connecting after these costs were spread, an up-front cash payment of $1,800 for Phase I and/or $570 for Phase II are required at time of connection. Similar new connections to the City's Sewer Utility pay $500 (Plant Equity Fee). * Total of yearly costs believed to be paid by FMC customers on the basis of the information obtained: $454.12. Note: These costs do not include any costs associated with sewer lateral assessments similar to those proposed to be assessed to the recently annexed Gilder's Garden and Gott's Additions. City Utility Costs: * Average bill for monthly sewer service for City Sewer Utility customers: Inside City = $131.04/yr. ($10.92/mo.) Outside City = $201.96/yr.($16.83/mo.) * Annual "savings" assuming FMC customers were acquired by the City Sewer Utility and charged at: Inside rates = $323.08/yr. Outside rates = $252.16/yr. Without an indication from the City Council or discussions with Sedgwick County regarding the options (above), Staff is reluctant to anticipate the costs of purchase of the FMC treatment and interceptor facilities owned by the County. If there was agreement by the County to sell the FMC facilities to the City's Sewer Utility, then it would be anticipated that such capital investments would be spread over the entire Wichita Utility customer-base. Such a practice is consistent with the philosophy for financing such facilities. Before cost estimates could be finalized and a financial model prepared, current and accurate information would be required from the County on its cost and debt service, along with added costs required to upgrade the plant facility. The method for assessing the costs of the FMC sewer system has been set by the Sedgwick County Commission. The costs associated with the system's core infrastructure have been assessed against all the property owners and the bonds have been issued. As additional areas are added to the system, the costs of lateral extensions are assessed to the property in those areas. The lateral assessments for the Gilders Garden and Gott Addition have been levied and spread. Any relief to property owners whose lateral assessments are extraordinarily high must come through the action of Sedgwick County. The County does have a program for deferring special assessments where the payment constitutes a financial hardship. Council Member Kamen Council Member Kamen said part of city being annexed in the 4-mile Creek area will be paying larger maintenance, operation, and connection fees than others in City. At present, there is no polarization of the issue between City and the County. There is now a court case between property owners and the County Commission regarding spread of special assessments. Once the assessments are spread it will be considerably harder to do anything in area. In 1989, the City offered to purchase the sewer line from the County but the City and County were about $1 million apart and the matter was dropped. There are two issues: The special assessments on Phase II and Those who have not paid for Phase I There is also operation and management of the sewer. City staff believes the operation and maintenance can be done at lesser fee. The special assessments are more complex. This is an extremely high priority as District II boundaries rush toward the Butler County line. Council Member Kamen said he is asking that City Staff contact the County and begin negotiations on 4-mile creek. This is not an election issue - this has to be done. It would be wise to see if anything can be done within the next 30 days because of the spread of assessments. Mayor Knight Mayor Knight inquired if anyone wished to be heard and no one appeared. On March 5, 1996, the City Council approved an Agreement with the Kansas Department of Transportation (KDOT) for a street resurfacing project (KLINK) on Kellogg from the west side of Waverly Street east to Rock Road, and the intersection of Kellogg Avenue and Greenwich Road. The Agreement provided that KDOT would reimburse the City in the amount of 50 percent of the approved construction cost including construction engineering and contingencies, but not to exceed a maximum of $100,000. The City took bids in December of 1995 and awarded the contract to Ritchie Paving for $225,000. Due to funding limitations the street resurfacing project (KLINK) on Kellogg was stopped at Armour Street. Total amount spent was $208,000. An invoice was prepared and submitted to KDOT. KDOT has advised that in order to pay the invoice they need a signed document that changes the limits of the project to Kellogg from the west side of Waverly Street east to Armour, and the intersection of Kellogg Avenue and Greenwich Road. The City has begun the implementation of its computer system to client/server technology as recommended in the City's Management Information System (MIS) Strategic Plan. The Public Safety computer system was installed in 1989 and was the first of the City's systems to utilize relational database technology. The City has the opportunity to complete the migration to client/server technology by contracting with the public safety system vendor, PRC Public Sector, Inc., to be the site for its new Automated Records Interface system. The Automated Records Interface is a graphical user interface (GUI) to the Public Safety Records Management system. The system offers all the functionality that PC's have to offer including pull down menus, the ability to access multiple records at one time, and access to "user friendly" report generation software. The ORACLE database will soon be upgraded to the last version supported on the current hardware platform (Version 7.1). The public safety system vendor will be utilizing PowerBuilder to write the new Automated Records Interface software which is also the product of choice for the City's new Finance and Central Inspection systems. The cost to purchase the Automated Records Interface (ARI) system is $200,000. Workstation licenses are required at $125 each. There will be a total of 200 licenses required in the Police Department and Municipal Court at a cost of $18,750. Personal Computers will be required as workstations for this implementation in the Police Department, Municipal Court, Prosecutor's Office and the City Hall Express. Upgraded cabling costs as a part of terminal replacement are estimated at $9,000. In addition, these departments use 60 Personal Computers which will cost $150,000. The upgrade to the ARI system will allow public safety system users the capability to continue the migration to a fully integrated client/server which will provide more efficiency in records management. The cost to implement the Automated Records Interface is estimated at $377,750 and will be funded in combination by the Police Department through the Federal Equitable Sharing Program funding (Narcotics Seizure) and the Municipal Court through driver's licenses reinstatement fees. The Purchasing Ordinance provides for the purchase of equipment and supplies from sole sources of supply. The State of Kansas administers the Edward Byrne Memorial Law Enforcement Assistance Grant Program (Byrne Grant), which provides Federal grants to state and local law enforcement agencies to fund programs in 25 designated program categories. The City of Wichita has received funding from the Byrne Grant in the past to fund programs such as the Special Community Action Teams (S.C.A.T.) and Drug Abuse Resistance Education (D.A.R.E.). The Police Department requests approval to submit Byrne Grant applications for the funding of four (4) programs. The first program is for training and computer equipment to improve the Police Department's ability to investigate crimes involving computers such as child pornography and fraud. The second program is for computer equipment to improve the Police Department's ability to conduct crime scene investigations and evidence collection. The third program is for equipment and literature for the Police Department to improve enforcement and community education efforts regarding traffic safety. The fourth program is for domestic violence training for criminal justice practitioners, and domestic violence curriculum development for the Police/School Liaison Section. To that end, the Police Department is seeking $16,400. through the Safe & Drug-Free Schools & Communities Grant Program to fund a pilot D.A.R.E. middle school program in two local middle schools and for the purchase of D.A.R.E. workbooks, teaching materials, and brochures. On November 4, 1997, the City Council approved the issuance of a Letter of Intent for Industrial Revenue Bonds in an amount not to exceed $11 million to Royal Caribbean Cruises Ltd. The Bonds are to be issued in two phases and used to finance the cost of acquiring, constructing and equipping a telephone reservation facility located at 4729 S. Palisade, in south Wichita, and to purchase equipment for their telephone reservation business. Bonds, in the amount of $6 million for Phase I of the project, were issued in November of 1997. The Royal Caribbean Letter of Intent needs to be extended for 6 months to allow the issuance of bonds for Phase II of the project. Royal Caribbean requested that the City Council issue their Letter of Intent for a period of 1 year to permit them to complete both phases of their project before issuing bonds. The Letter of Intent, however, was inadvertently drafted and executed for a 6-month term ending May 4, 1998. Extending the term of the Letter of Intent for an additional 6-months will allow Royal Caribbean to complete their project prior to issuing bonds for Phase II of the project. Royal Caribbean agrees to pay all costs of issuing the bonds and agrees to pay the City's $2,500 annual IRB administrative fee for the term of the bonds. Royal Caribbean was granted a 100% tax abatement of ad valorem property taxes on the project for a five year period. A cost/benefit analysis was performed by Wichita State University showing benefit-to-cost ratios of 2.04 for the City; 2.49 for the County; 0.94 for U.S.D. 259 and 15.14 for the State. (District VI) Agenda Report No. 98-351. The Central Avenue Improvement Project from West Street to McLean Boulevard, approved by City Council on September 17, 1996, requires the acquisition of fifteen partial tracts along Central Avenue. One of these tracts includes Tract #14 which is owned by Ronald F. And Joanne M. Brown. The subject tract contains approximately 112.50 square feet and will require the loss of the use of one parking space, but will not affect any improvement on the remaining property. Due to the small size of the taking, the value of the tract is minimal. Market studies of the area indicate a value of $4.00 per square foot or $450. An extra $550 has been added as compensation for the loss of parking space. The property owner has agreed to sell the property to the City for the total of $1,000. The 1996 Capital Improvement Program includes $50,000 to acquire the necessary right of way for the project along Central. The funding source is General Obligation Bonds. The budget of $1,250 includes $1,000 for the acquisition and $250 for closing costs. The prior approved budget was $34,510. The $1,250 would increase the total expenditures to date to $35,760. This is the eighth property acquisition for the project, leaving seven properties to be acquired through negotiations or eminent domain. The Central Avenue Improvement Project from West Street to McLean Boulevard, approved by City Council on September 17, 1996, requires the acquisition of fifteen partial tracts along Central Avenue. To date twelve owners have accepted the City's offer to purchase the right of way. Negotiations with these owners will continue during the eminent domain process. Staff has attempted to negotiate the purchase of these Tracts but has been unable to reach any agreement with the owners. Due to the time constraints of the project, eminent domain action is deemed advisable. Any properties that are acquired during the process can be dropped from the ordinance. Early in 1997, the Council authorized the acquisition by eminent domain of a tract of land near 21st Street and Hoover Road in connection with the siting of the Northwest Water Distribution and Treatment Facility. The property is owned by Victor B. and Johnnie B. Eisenring. Negotiations with the owners for purchase of their interest was unsuccessful. An eminent domain action was filed in the District Court. That proceeding was concluded with the filing of the appraisers' report on April 1, 1998. The appraisers' award for the taking is $ 500,000. In addition to the award, the Court awarded each of the three appraisers the sum of $1,500 each for appraisers' fees. Court costs are to be paid by the City in the amount of $66.50. If the City wishes to acquire this property, it must pay to the Clerk of the District Court the sum of $ 504,566.50 on or before May 1, 1998. This is the amount of the award, plus fees and court costs. The cost of acquiring this property will be paid by the City out of Water Utility funds allocated for the project. So long as the City must acquire this property for the project, it must pay the $ 504.566.50 into the Clerk of the District Court on or before May 1, 1998, or the eminent domain proceeding will be deemed abandoned. Ms. Orcutt and her brother, William, were both injured as a result of an auto accident on June 30, 1997, in which Ms. Orcutt's vehicle collided with a dump truck being driven by an employee of the City working for the Stormwater Management Division. The accident happened on I-135 near the Lincoln Street exit. As a result of the accident the Orcutt's suffered personal injuries. After investigation of the claims and nature of the injuries, the risks associated with defending a lawsuit through trial were considered by all parties. Ms. Orcutt has offered to accept a total of $18,375.00 as full settlement of all of her claims for personal injury. Mr. Orcutt has offered to accept a total of $9750 in full settlement of his claims for personal injury. Because there is a risk that the judgment at trial could exceed this amount, the Law Department and outside counsel recommend acceptance of this offer. The settlement of this claim does not constitute an admission of liability on the part of the City. Rather, it is merely a settlement to resolve a disputed claim. Funding for this settlement payment is from the City's tort claims fund. Some of these projects will require expertise currently not available on City staff or where other program commitments necessitate outside assistance. The Capital Improvement Program includes hundreds of projects to improve the City's infrastructure throughout the City over a ten year period. Many of the projects will require outside expertise to assist with project development and implementation. Specific functions include working with staff to development plans for citizen education and involvement and coordination of the multiplicity of action steps necessary for project implementation.
