NEW BUSINESS

10a.	Approval of Gander Mountain Non-Disturbance Agreement.  (District I)

In order to finalize its lease agreement with Gander Mountain and proceed with a construction phase closing, WaterWalk LLC is requesting the City enter into a Non-Disturbance Agreement with Gander Mountain.

RECOMMENDED ACTION:	Approve the Non-Disturbance Agreement with 
				Gander Mountain and amendments to the Legal
				Description for Ground Lease No. 1, the Declaration
				of Covenants, Conditions and Restrictions and the
				Highway Permit for Use of Right of Way and 
				authorize the Mayor to sign.
