Wichita Board of Appeals of Plumbers and Gas Fitters Minutes Wednesday, October 3rd, 2007 Present: Terry Irwin, Richard Tade, Don Vaughn Sr., David Lefler, Leon Breedlove, Keith Brewer Members Absent: Jerry Short Staff: Dan Leidy, Sharon Dickgrafe w/ Law Department, Billie Vines w/ Water Department and Laura Hernandez w/ Central Inspection Guests Present: Don Patry, from The Tap; Richard Taylor, from Local 441; David Finley, from Mechanical Sheet Metal Contractor Association; Kerry Stine, from Local 441; Ray Frederick, from Frederick Heating & Plumbing; Ted Graves, from Dillons; Robert Francis, from R & C Professional Services; Brent Wilson, from Wichita Eagle; Mark Herndon, from the PACK; Lonny Wright, from Local 441; John Clark, from Local 441; Mike Dirck, from A-Plus Plumbing; Rodger Eatron, from Eaton Plumbing; Phil Padgett, from Padgett Enterprises; Bob Shepherd, from IAPMO; John Shepherd, from Local 441; Gary Trusler, from Dillons and Terry Winn, from Law Company Don Vaughn, seconded by David Lefler, moved to accept the September minutes, motion carried 6-0. Bob Francis addressed the Board over issues of the Dillons stores. Mr. Trusler and Mr. Graves stated that all of the other Dillons stores have had their plumbing plans changed to meet the Uniform Plumbing Code. The Board decided that if certain requirements were made then they would allow the existing plumbing to stay. Keith Brewer, seconded by David Lefler, made the motion that if they would reduce the tailpiece on the sink from 2" to 1 1/2" and cut the tailpiece at 45 degrees to restrict turbulence, they would grant the variance. Motion carried 6-0. Billie Vines addressed the board with his concerns of the "water back up sump pumps". He specifically talked about Home Guard and Liberty Sump Jet. Billie Vines felt that these are proposing a health hazard and they should be protected with an RPZ and tested annually by a certified tester. After much discussion, David Lefler, seconded by Richard Tade, moved that Billie Vines put in writing what he believes would be appropriate and bring it to the next board meeting for review. Motion carried 6-0. Mark Herndon (PACK President) addressed the Board with his intentions of presenting to City Council that they had 55 companies in the Wichita area that was in support of the 2006 IPC. He also had 135 Certified Tradesmen with signatures and numerous letters in support of the 2006 IPC. Mark Herndon stated they most were polled from the PACK membership. Bob Shepherd stated that he was a member of the PACK and he did not receive any such poll from the PACK. He also stated that obviously he was not in favor of the IPC. Leon Breedlove stated that anyone who wanted to sign up in support of the IPC was welcome to do so. Mr. Breedlove stated, in the form of a motion, that the Plumbing Board had already voted to recommend the 2006 IPC to Council and requested the Amendments be completed by OCI and presented to the Board at the next meeting and also present to Legal, motion was second by Don Vaughn, motion carried 6-0. Mr. Ray Frederick asked Staff if there was not a directive from Council concerning the IPC. Dan Leidy responded to Ray Frederick that Kurt Schroeder told him that the City Manager had told him that council was not going to accept any recommendation to the plumbing code at this time. Mr. Leidy told Mr. Frederick that he took this information to the Chairman of the Board. Mr. Frederick than asked Terry Irwin what he heard from Mr. Leidy. Mr. Irwin stated that it something like 'the plumbing code is dead at this point'. Mr. Frederick stated that the Council had sent a strong signal for no action to be taken. The Board was concerned about all of the talk and wondered why Council or the City Manager did not send a memo to the Board with their request? The Board felt that certainly would clarify the issue. The Board went into executive session at 10:12 a.m. for twenty minutes to discuss legal matters concerning attorney client privilege.
