BOARD OF CODE STANDARDS AND APPEALS MINUTES May 7, 2007 Members: Francisco Banuelos, Randy Coonrod, Randy Harder, Richard Hartwell, Bernie Hentzen, Gerald Herzberg, Ed Murabito, Warren Willenberg, John Youle Present: Coonrod, Harder, Hartwell, Hentzen, Herzberg, Murabito, Willenberg Staff Members Present: Deb Legge, Maria Bias, Laura Hernandez, Sharon Dickgrafe, Elaine Hammons The regular meeting of the Board of Code Standards and Appeals was called to order by Chairman Murabito on Monday, May 7, 2007, at 1:32 p.m. in the City Council Chambers, 1st floor, City Hall, 455 N. Main, Wichita, Kansas. 1. Approval of the Minutes of the April 2, 2007, meeting. A motion was made by Board Member Hartwell to approve the minutes of the April 2, 2007, meeting as submitted. Board Member Willenberg seconded the motion. The motion carried, unopposed. 2. Approval of the April 2007 license examination application(s) as follows: Name Class Test Date Jesse Ybarra Roofing & Siding May 2007 Lance Hoffine Roofing & Siding May 2007 Tim Weddington (Off agenda) Swimming Pool May 2007 Board Member Coonrod made a motion to approve the license examination applications for testing. Board Member Hentzen seconded the motion. The motion was approved. Chairman Murabito requested that the Board Members and City Staff introduce themselves to the citizens in attendance. 3. Condemnation Hearings Review Cases: 1. 2612 East 13th There was no one in attendance to represent this property. This structure is a one-story, frame dwelling, approximately 24 X 63 feet in size. Vacant for over a year, this building is partially boarded. The block foundation is cracking, and the concrete slab porch is cracked. BCSA Meeting May 7, 2007 Page Two At the February 5, 2007, hearing, a motion was approved to grant an extension until the May 7, 2007, meeting to permit the owner to complete the exterior repairs. Although the building is secure, no repairs have been made, and there is some trash and debris on the premises. Board Member Harder made a motion to refer the property to the City Council with a recommendation of demolition, ten days to begin demolition and ten days to complete demolition. Board Member Hartwell seconded the motion. The motion was unanimously approved. 2. 2843 East Stadium There was no representative on behalf of this property. This single story frame dwelling is about 24 X 30 feet in size. The taxes are current. A recent site inspection by Central Inspection staff revealed that new windows have been installed and the trim has been painted. The painting on the exterior siding needs to be completed. Central Inspection staff recommended that the property be returned to regular code enforcement. Board Member Coonrod made a motion to return the property to regular code enforcement. Board Member Hentzen seconded the motion. The motion carried. 3. 522 North Chautauqua There was no one attending the hearing as a representative of this property. This is a one-story frame dwelling approximately 27 X 60 feet in size. At the April 2, 2007, hearing, Ms. Legge informed the Board that the owner of the property had contacted her by telephone, requesting an additional thirty days to complete the painting that had been delayed by rainy weather conditions. A motion was granted to allow the additional thirty days. The exterior repairs have been completed, except for some painting and repair to the screen door on the south side. The building is secure. Central Inspection staff recommended that the property be returned to regular code enforcement. Board Member Hentzen made a motion to return the property to regular code enforcement. Board Member Harder seconded the motion. The motion was approved. 4. 1147 North Green This property was inadvertently placed on the agenda for May 7, 2007, and did not require action at that time. 5. 1746 North Kansas Addison DeAllie attended the hearing as the representative for this property. BCSA Meeting May 7, 2007 Page Three This property was first before the Board at the February 5, 2007, hearing. Mr. DeAllie was present at that hearing, at which time the Board approved a motion to allow ninety days to finish the repairs of the property or reappear before the Board. Most of the exterior repairs are complete. The 2006 taxes are due in the amount of $44.96; there is some construction debris on the site; there is new siding, a new roof, and new windows have been installed. The recommendation from Central Inspection staff is that the property be returned to regular code enforcement. Mr. DeAllie told the Board that all the construction debris has been removed from the property. He explained that he still has the windows boarded to prevent vandalism and theft while the interior repairs are being completed. Board Member Harder made a motion to return the property to regular code enforcement. Board Member Coonrod seconded the motion. The motion was approved. 6. 1726 South Millwood The property was represented by Jeffrey Tackett. This property was originally before the Board on the February 5, 2007, hearing, and again at the April 2, 2007, hearing. At the April 2nd hearing, a motion was approved to allow thirty days for the premises to be cleared of junk and debris; that the dangerous condition of the side porch be addressed; and the delinquent taxes paid. The taxes are now current. Some trees have been removed; there are some tree limbs and tree debris on the premises; there is a trailer parked on the grass in the front yard. No exterior repairs have been made; there is a tarp covering a hole in the roof on the north side. Mr. Tackett informed the Board that the decision had been made to raze the structure. He told the Board that he had been working on the interior of the structure, removing metal and sheetrock, to prepare it for wrecking. Mr. Tackett also explained that he had been doing the work without any assistance. Chairman Murabito inquired about the anticipated time frame for completing the demolition of the building. Mr. Tackett said that he was expecting to have the structure demolished within sixty days. Board Member Coonrod made a motion to allow thirty days for demolition of the structure or the property would be referred to the City Council with a recommendation of demolition, with ten days to begin the wrecking and ten days to complete demolition. Board Member Harder seconded the motion. The motion was approved. New Cases: 7. 1645 North Mathewson There was no one in attendance to represent this property. BCSA Meeting May 7, 2007 Page Four This one-story masonry dwelling is approximately 28 X 36 feet in size; it has been vacant for at least three years. The structure has a sagging, deteriorated composition roof; the masonite siding over the concrete block walls has deteriorated; there is rotted wood trim, and the porch cover is rotted. The owner of record has declared bankruptcy and is no longer the responsible party for this property. Board Member Willenberg made a motion to send the property to the City Council with a recommendation of demolition, ten days to start the demolition and ten days to complete the demolition. Board Member Hartwell seconded the motion. The motion was unanimously approved. 8. 2215 North Minneapolis There was no representative for this property attending the hearing. Vacant for more than two years, this 27 X 38 single story frame dwelling has a cracking and shifting concrete foundation. The concrete front porch is cracked; the porch cover support posts are shifting; the wood trim is rotted. The accessory storm shelter is open and hazardous. Board Member Coonrod made a motion to refer the property to the City Council for demolition, with ten days to begin razing the structure and ten days to complete the removal of the structure. Board Member Harder seconded the motion. The motion was approved without opposition. 9. 1927 East Looman There was no representative in attendance. About 28 X 50 feet in size, this one-story frame dwelling is vacant and open. The composition roof is badly deteriorated; there are broken and missing asbestos siding shingles; there are rotted and missing masonite siding shingles; there are rotted and exposed framing members. The initial case was started on this property in February of 2005. There has been no response to any of the notices issued to the owner. The 2006 taxes are delinquent in the amount of $346.41. Board Member Coonrod made a motion that the property be referred to the City Council with a recommendation of demolition, ten days to begin demolition and ten days to complete the demolition. Board Member Willenberg seconded the motion. The motion was approved. 10. 917 North Oliver No one attended the hearing as a representative of this property. BCSA Meeting May 7, 2007 Page Five This one-story frame dwelling is about 28 X 32 feet in size. It has been vacant for approximately two years. The structure has a deteriorated and collapsing composition roof; it has a collapsed chimney; there are exposed and rotted framing members. Board Member Willenberg made a motion to send the property before the City Council, with a recommendation of ten days to start demolition and ten days to complete the demolition. Board Member Hartwell seconded the motion. The motion was approved by the Board. 11. 856 North Oliver There was no representative in attendance for this property. The active file was initiated on this property on July 11, 2005. The structure is a one-story brick-over-frame four-plex, approximately 21 X 84 feet in size. The structure is vacant and open; there is an open basement access. Board Member Harder made a motion to send the property to the City Council, recommending ten days to begin demolition and ten days to complete demolition. Board Member Hartwell seconded the motion. The motion was approved. 12. 1117 South Main There was no representative present for this property. This frame structure is two and one-half stories, approximately 35 X 38 feet in size. The first floor is secure; however, the second story is open. Since the active file was started on this site on June 16, 2005, Central Inspection has boarded up the dwelling three times. Board Member Coonrod made a motion to refer the property to the City Council with a recommendation of demolition, ten days to begin wrecking the structure and ten days to complete the demolition. Board Member Willenberg seconded the motion. The motion was unanimously approved. 13. 1430 South St. Francis Jim Lawing, court appointed attorney, represented the interests of the property. Also appearing on behalf of one of the heirs, John Simpson, was attorney Michael Wilson. This one-story, frame dwelling, is approximately 26 X 38 feet in size. It has been vacant for at least two years; the structure has an open cellar; there are deteriorated and missing wood siding shingles; the composition roof has missing shingles and is badly worn. The 2006 taxes are delinquent and there is a special assessment against the property for weed mowing. Currently there is tall grass and weeds on the premise; a pile of brush and debris is also on the site; and a trailer is parked in the driveway. The house is secure; the open cellar does not allow entry to the main structure. BCSA Meeting May 7, 2007 Page Six Mr. Lawing addressed the Board, explaining that the City of Wichita was the lien holder on a $12,000 note on the property. The will of the deceased owner, Mr. Lawing added, was at his law office, and he needed a reasonable amount of time to contact the heirs. Board Member Harder made a motion that the attorneys be allowed sixty days to make the necessary contact with the heirs and resolve the issue of whether the house was to be repaired or razed. Board Member Coonrod seconded the motion and included that the site would be kept in a clean condition and the structure secured. The motion carried, unopposed. 14. 319 South Dodge There was no representative present on behalf of this property. This one and one-half story frame dwelling is approximately 36 X 36 feet in size. Damaged by fire, it is vacant and open. Board Member Harder made a motion to refer the property to the City Council for condemnation, ten days to start the demolition and ten days to complete the demolition. Board Member Coonrod seconded the motion. The motion carried. 15. 2402 West 29th N. #20 There was no one attending the hearing as a representative for this property. This structure is a 10 X 60 foot mobile home. It is vacant and open; it has broken windows; the metal siding is deteriorated. There is tall grass and weeds on the premises. There has been an ongoing problem with graffiti. Board Member Willenberg made a motion to refer the property to the City Council, recommending that the structure be razed, with ten days to begin demolition and ten days to complete demolition. Board Member Harder seconded the motion. The motion carried. With no other business to conduct, Board Member Hartwell made a motion to adjourn the meeting. Board Member Willenberg seconded the motion. The motion was approved. The meeting adjourned at 2:01 p.m.
