24.1 Traffic offenses as designated by ordinance, with the exception of DUIs, may be assigned for arraignment before the Administrative Traffic Court. 24.2 At arraignment the defendant will be given the opportunity for an immediate administrative hearing on the merits of his or her ticket if the offense qualifies for administrative hearing. Only violations that do not carry a potential jail sentence are eligible for an administrative hearing. Prior to an administrative hearing each defendant will sign a written waiver consenting to hearing by administrative trial. Cases that do not qualify for an administrative hearing will be set on the criminal/traffic docket. 24.3 The administrative hearings will be conducted pursuant to informal administrative procedures consistent with City Code Section 1.04.155 and other ordinances of the City of Wichita and these Rules. Defense attorneys and prosecutors are not permitted to argue cases before the Administrative Hearing Officer. The officer(s) issuing the ticket will be responsible for presenting evidence and representing the City. 24.4 Appeals of rulings of the administrative traffic court will follow the procedures outlined for appeal in Rule 22.
